AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Products sold by POWER MOWER SERVICE PTY. LTD are covered by their respective manufacturers’ warranty and assurance.

Consumer Rights

The buyer should be aware that in relation to Consumer Rights goods which are of a kind ordinarily acquired for personal, domestic or household use or consumption, certain provisions such as the Competition and Consumer Act 2010 (previously known as the Trade Practices Act 1974 (TPA)) (Aust) and the Consumer Guarantees Act, 1993 (NZ) apply. The terms set out below do not exclude rights and remedies implied by a statute which are non-excludable and which may be more extensive than those provided by this warranty.

POWER MOWER SERVICE PTY. LTD. stands behind the quality of its PowerMow brand of outdoor products and offers a comprehensive warranty to the original retail purchaser. This warranty guarantees that the product is free from defects in material and workmanship, and POWER MOWER SERVICE PTY. LTD. commits to repairing or replacing any defective product at its discretion, free of charge, within specified time frames from the date of purchase.

This warranty is exclusive to the original retail purchaser, commencing on the date of the original retail purchase. In the event that any part of the product is found to be defective, POWER MOWER SERVICE PTY. LTD., in its reasonable judgment, will undertake the repair or replacement of the defective part without any cost for parts and labour. PowerMowers servicing dealers are authorised to determine whether a claim will be covered under warranty, or payable by the owner on completion. Parts and accessories replaced under this warranty are warranted only for the remaining balance of the original warranty period. To exercise the warranty, the product, along with any defective part, must be returned to an authorised PowerMowers dealer within the stipulated warranty period. The owner is responsible for covering the expenses associated with delivering the product to the dealer for warranty work, as well as the costs of returning it after repair or replacement. POWER MOWER SERVICE PTY. LTD. responsibility regarding warranty claims is limited to the necessary repairs or replacements. No claim of breach of warranty shall serve as grounds for the cancellation or rescission of the sales contract for any supported brand of outdoor product. Proof of purchase is a prerequisite for substantiating any warranty claim, and all warranty work must be performed by an authorised PowerMowers dealer. It is crucial to note that the warranty does not cover products subjected to misuse, neglect, negligence, or accidents, or those operated contrary to the specified operating instructions in the Operator’s Manual. Furthermore, the warranty does not extend to damage resulting from improper maintenance, alterations, modifications, or repairs necessitated by normal wear.

THIS WARRANTY DOES NOT COVER DAMAGE CAUSED BY:

• Lack of lubrication or engine failure, due to the use of two-stroke oils that do not meet the ISO-L-EGD (ISO/CD 13738) and JASO M345FD Standards. Engine problems due to inadequate lubrication caused by failure to use an ISO-L-EGD compliant and JASO M345FD registered oil.

• Damage caused by use of degraded fuels or fuels containing more than 10% ethanol by volume. The prescribed mixing ratio of petrol to oil is covered in your operator’s manual. 

• Engine damage caused by use of any starting fluids.  

• Damage caused by tampering with engine speed governor or emission components, or running engines above specified and recommended engine speeds as listed in your operator’s manual.

• Operation of the unit with improperly maintained/removed cutting shield or removed/damaged air filter.  

• Damage caused by dirt, pressure or steam cleaning the unit, salt water, corrosion, rust, varnish, abrasives, and moisture.

• Defects, malfunctions or failures resulting from abuse, misuse, neglect, modifications, alterations, normal wear, improper servicing, or use of unauthorised attachments.

• Incorrect storage procedures, stale fuel, including failure to provide or perform required maintenance services (as prescribed in the operator's manual). Preventative maintenance is the customer’s responsibility.

• Failures due to improper set-up, pre-delivery service or repair service by anyone other than authorised PowerMowers servicing dealers during the warranty period.

• Use of spark plugs other than those meeting performance and durability requirements of the OEM spark plug. 

• Overheating or carbon scoring failures due to restricted, clogged exhaust port or combustion chamber, including damage to spark arrester screen.

• Adjustments such as carburetor adjustment and throttle cable adjustment.

• Damage to gears or gear cases caused by contaminated grease or oil, use of incorrect type or viscosity of lubricants, and/or failure to comply with recommended grease or oil change intervals.

• Damage caused by loading beyond recommended capacity.

• Damage caused by pump or sprayer running dry, pumping or spraying caustic or flammable materials, or lack of or broken strainers.

• Additional damage to parts or components due to continued use after operational problem or failure occurs. Should operational problem or failure occur, the product should not be used, but delivered as is to an authorised PowerMowers servicing dealer.

Certain parts and other items are not warranted, including but not limited to consumable items such as nylon trimmer line, and spark plugs.

POWER MOWER SERVICE PTY. LTD. retains the right to change or improve the design of its products without assuming any obligation to modify previously manufactured items. All implied warranties are explicitly limited in duration to the stated warranty period. Consequently, any implied warranties, including but not limited to merchantability, fitness for a particular purpose, or otherwise, are disclaimed in their entirety after the expiration of the appropriate period. The obligation of POWER MOWER SERVICE PTY. LTD. under this warranty is strictly and exclusively limited to the repair or replacement of defective parts. POWER MOWER SERVICE PTY. LTD. expressly disclaims responsibility for incidental, consequential, or other damages, including but not limited to the expense of returning the product to an authorised PowerMowers servicing dealer for, the expense of delivering it back to the owner, mechanic’s travel time, telephone charges, rental of a like product during the time warranty service is being performed, travel, loss or damage to personal property, loss of revenue, loss of use of the product, loss of time, or inconvenience.
